Paying Filing Fee in Installments When E-filing Petition

Pay Accrued Filing Fees First

We recommend that you pay all accrued fees in CM-ECF before you file a case for which you will be applying to pay the filing fee in installments (this is to help you avoid inadvertent payment of the waived fee or automatic deactivation of your CM-ECF account).  Refer to the Online Credit Card Payments manual for more information.

Use Local Form

We require use of our local form, NM Form 508, Application to Pay Filing Fee in Installments, instead of Official Form B3A.  NM Form 508 is available in pdf, WordPerfect, and MS WORD formats on our Forms for Attorneys web page.

Instructions

  1. Please follow these instructions in the Open Voluntary BK Case event in CM-ECF.
    • At the first statistical screen, select  Installment as the Fee Status.
    • At the screen displaying the fee, DO NOT CHANGE THE FEE AMOUNT, even though the option to do so appears to be available.
    • At the Pay.gov screen, click on “Continue Filing.”  DO NOT PAY A FEE.
  2. After the case is filed, file the Application as follows:
    • Click on Search in the CM-ECF blue menu bar.
    • Type in pay filing fee in installments’ and press Enter.
    • Click on Pay Filing Fee in Installments (Motion).  Enter case number and proceed to file application.
  3. Call the Clerk's Office at 505-348-2500 to ask an Intake Clerk to remove the fee from the Internet Payments Due report.
  4. The fee must be removed from the Internet Payments Due report before you pay the first installment.
  5. Make the first installment payment as follows:
    • Click on Search in the CM-ECF blue menu bar.
    • Type in installments’ and press Enter.
    • Click on the chapter-appropriate installment payment event under Bankruptcy Events→Miscellaneous.  Enter case number and proceed through the event.  This event will ask you to enter the amount of the installment payment; you must enter the dollar amount, and when the Pay.gov screen pops up, pay the fee.
  6. Submit your proposed order, NM Form 509, in MS Word or WordPerfect format via e-mail to web_ops [at] nmcourt [dot] fed [dot] us.   In the subject line, enter something like the following, using the correct case number:  Order for installment payments, 09-10101 MA.   You don’t need any other text – just attach the order file to the message.
