Correcting Social Security Numbers
In New Mexico, it is the responsibility of the attorney for the debtor or the self-represented debtor to check the "Notice of Chapter X Bankruptcy Case, Meeting of Creditors, and Deadlines" within 60 days of submission of the statement of social security number(s) to be sure the correct number(s) were displayed on the Notice. If an error is found, the debtor should proceed as follows:
- Prepare and file an Amended Statement of Social Security Number(s). (note: this form is a pdf fillable form; this means you can complete it online and print it for signature)
- If the debtor is represented by an attorney:
The attorney for the debtor should e-file an Amended Statement of Social Security Number. [In CM-ECF, from the Bankruptcy - Miscellaneous events menu, select the "Statement of Social Security Number" (the same event code used to file the original Statement of Social Security Number) and, in the docket entry before submitting the document, select "Amended" from the pick-list on the docket entry screen.]
- If the debtor is not represented by an attorney:
The debtor should prepare and sign an Amended Statement of Social Security Number and send it to the Clerk's Office, U. S. Bankruptcy Court, District of New Mexico, PO Box 546, Albuquerque, NM 87103-0546.
- If the debtor is represented by an attorney:
- Send a Notice of Correction of Social Security Number(s) to all creditors and parties of record in the case and file a Certificate of Mailing of Notice of Correction of Social Security Number(s) with the Clerk's Office.
Pursuant to NM LBR 1007-5: "the debtor shall provide a copy of the statement to the trustee, all creditors and indenture trustees. Within two days thereafter, a certificate of compliance with this rule shall be filed with the clerk. Failure to provide the statement or to file the certificate of compliance may subject the individual debtor to sanctions, including dismissal of the case."
