2010-4: Judge Jacobvitz Changes to Preliminary Hearings Approach to Confirmation of Chapter 13 Plans

Effective for cases filed on or after December 30, 2009, Judge Robert H. Jacobvitz is scheduling the initial hearing on confirmation of chapter 13 plans as a preliminary hearing.  Preliminary hearings will be held in his Hearing Room on the east wing of the 13th floor of the courthouse – Judge Jacobvitz’ s Hearing Room, Dennis Chavez Federal Building and United States Courthouse, 500 Gold Avenue SW, Room 13017, Albuquerque, New Mexico.

The following Court forms have been updated to reflect this change:

  1. Notice of Deadline for Filing Objections to Confirmation of Chapter 13 Plan (NM Form 600, rev. 01-22-10) used when plan and notice are filed with the petition;
  2. Notice of Deadline for Filing Objections to Confirmation of Chapter 13 Plan (NM Form 601, rev. 01-25-10) used when plan and notice are filed on a different day, after the petition is filed; and
  3. Hearing Location Guide
