How to File
The following instructions are specifically provided for self-represented persons filing a bankruptcy petition. If you are considering filing without representation by an attorney and have not already read all of the information on the Before You File page, please do so now.
Please also read "FILING BANKRUPTCY IN NEW MEXICO" - (English version) (Spanish version) - a brochure prepared by the State Bar of New Mexico, March 17, 2008. The brochure may also be obtained by contacting the Clerk's Office.
Whether you file a chapter 7 or 13 case, you start with the same basic set of forms. The forms for filing a petition are referenced on this page. Additional forms and procedures are available on the Debtor Forms and Debtor Forms & Procedures pages.
Please note that NM LBR 1074-1 requires corporations and partnerships to be represented by an attorney.
Filing a Chapter 7 or 13 Bankruptcy Case
The requirements for filing a Chapter 7 or Chapter 13 bankruptcy case are divided into two sections: minimum requirements and additional requirements. The minimum requirements are the requirements that must be met in order to file the petition. Additional requirements must be met by some date after the filing of the petition, but may be met before or at the time of filing.
